In the following we provide information within the scope of our information obligations (Art. 13 ff. DS-GVO) about the collection of personal data when using our website www.fuenve.com. Personal data is all data that can be related to you personally, e.g. name, address, e-mail addresses, user behavior. You will also receive information on how we protect your data from a technical and organizational point of view and what rights you have towards us and the responsible supervisory authority.

When you contact us by e-mail, the data you provide (your e-mail address, your name and phone number) is stored by us to answer your questions. We delete the data arising in this context after the storage is no longer necessary, or restrict the processing if there are statutory storage obligations.

If we use commissioned service providers for individual functions of our offer or would like to use your data for advertising purposes, we will inform you in detail below about the respective processes. We also state the specified criteria for the storage period.

3. COLLECTION OF PERSONAL DATA WHEN VISITING OUR WEBSITE

(1) If you only use the website for informational purposes, i.e. if you do not register or otherwise provide us with information, we only collect the personal data that your browser transmits to our server. The personal data are used for the fulfillment, processing and billing of the contractual relationship, including other actions such as complaints, inquiries, billing, etc. and they are stored in a customer profile. For fuenve.com it is absolutely necessary to pass on personal data to respective contractual partners, such as external logistics partners.

(2) In addition to the aforementioned data, cookies are stored on your computer or mobile device when you use our website. Cookies are small text files that are stored on your hard drive, assigned to the browser you are using and through which certain information flows to the place that sets the cookie (in this case that's us). Cookies cannot run programs or transfer viruses to your computer. They serve to make the internet more user-friendly and effective overall. Please also note our separate cookie notice.

a) This website uses the following types of cookies, the scope and functionality of which are explained below:

– Transient cookies (see b)
– Persistent cookies (see c).

b) Transient cookies are automatically deleted when you close the browser. These include in particular the session cookies. These store a so-called session ID, with which various requests from your browser can be assigned to the joint session. This allows your computer to be recognized when you return to our website. The session cookies are deleted when you log out or close the browser.

c) Persistent cookies are automatically deleted after a specified period, which can vary depending on the cookie. You can delete the cookies in the security settings of your browser at any time.

Use of Google Analytics
On our website, the analysis service Google Analytics, provided by Google LLC, 1600 Amphitheater Parkway Mountain View, CA 94043, USA (hereinafter: "Google Analytics"), is implemented. Google Analytics sets cookies that store the following information:

This website uses Google Analytics with the extension "_anonymizeIp()". As a result, IP addresses are further processed in abbreviated form, which means that they cannot be linked to individuals. If the data collected about you has a personal reference, this will be excluded immediately and the personal data will be deleted immediately.

We use Google Analytics to analyze and regularly improve the usability of our website. We can use the statistics obtained to improve our offer and make it more interesting for you as a user. 4. OTHER FUNCTIONS AND OFFERS ON OUR WEBSITE

In addition to the purely informational use of our website, we offer various services that you can use if you are interested. To do this, you usually have to provide additional personal data that we use to provide the respective service and for which the aforementioned data processing principles apply.

In some cases, we use external service providers to process your data. These have been carefully selected and commissioned by us, are bound by our instructions and are regularly checked.

Furthermore, we can pass on your personal data to third parties if we offer participation in campaigns, competitions, conclusion of contracts or similar services together with partners. 4.1. USE OF OUR WEBSHOP

Orders
(1) If you would like to order in our web shop, it is necessary for the conclusion of the contract that you provide your personal data, which we need to process your order. Mandatory information required for the processing of the contracts is marked separately, further information is voluntary. We process the data you provide to process your order. For this we can pass on your payment data to our house bank. The legal basis for this is Art. 6 Abs. 1 S. 1 lit. b DSGVO
If you place an order on our website, we need the following data to fulfill the contract with you:

  • E-mail address to send you the order confirmation and to provide you with contract documents immediately after the order
  • Your payment information to process the payment of your order

We pass on your address data to our shipping or logistics service provider for the purpose of delivery.

(2) Due to commercial and tax law requirements, we are obliged to store your address, payment and order data for ten years.

(3) To prevent unauthorized access by third parties to your personal data, in particular financial data, the ordering process is TLS technique encrypted.

Payment methods and credit check
(1) We offer several payment methods in the web shop and use different payment service providers. Depending on which payment method you choose, different data will be transmitted to the respective payment service provider. The legal basis for the transmission is Art. 6 Abs. 1 S. 1 lit. a GDPR. Below we list our payment service providers.

a. Paypal
If you decide to use the PayPal payment method, your personal data will be transmitted to PayPal. The prerequisite for using PayPal is opening a PayPal account. The use or opening of a PayPal account requires, among other things, that your name, address, telephone number and e-mail address are being sent to PayPal. The legal basis for the transmission of the data is Article 6 Para. 1 lit. a GDPR (consent) and Article 6 Para. 1 lit. b GDPR (processing to fulfill a contract).

b. Credit card, Giropay, direct debit
Payments with credit card, Giropay and direct debit we process via the payment service provider StripePayments Europe Ltd., Block 4, Harcourt Centre, Harcourt Road, Dublin 2, Ireland. Stripe receives your personal data for electronic payment processing. The legal basis for this data processing is Art. 6 (1) lit. b DS-GVO.

Credit card: If you pay with your credit card on our website, your credit card provider will receive the information that you have placed an order with us. Your credit card provider may conduct a credit check. You can find more information on this on the respective website of your credit card provider.

4.2. NEWSLETTER

On our website you can sign up for our free Newsletter. In addition to your declaration of consent, we need your e-mail address for this. By sending the newsletter registration, you agree to the processing of your data by us. For sending the newsletter we use MailChimp.

Further information, e.g. your name, is voluntary and serves to address you personally. The legal basis for sending the newsletter is Art. 6 (1) lit. b DS-GVO in relation to your e-mail address, because we provide you with our service in this way and Art. 6 (1) lit. a DS-GVO in relation to other voluntarily provided data.

We will only send you the newsletter if you have previously confirmed your registration by clicking on the link provided in a confirmation e-mail sent to you for this purpose. We want to ensure that only you can register for the newsletter. Your confirmation in this regard must be made promptly after receipt of the confirmation e-mail, otherwise your newsletter registration will be automatically deleted from our database.

In addition, as part of your newsletter registration, we store the time (date and time) of the transmission of your data to us, as well as your IP address. The processing of this data corresponds to our legitimate interest acc. Art. 6 (1) lit. f DS-GVO to ensure the security of our systems and to counteract misuse.

Your data will not be passed on to third parties and will only be processed in connection with sending newsletters. The purpose of processing your e-mail address is to be able to send you the newsletter. Other data as part of the registration process is used either to address you personally or to ensure the security of our services and to prevent misuse of the email address used.

Your data will only be stored for as long as is necessary to achieve the purpose. Your e-mail address will therefore be saved for the period of your active newsletter subscription if you have given your consent. The data that we also automatically collect during your registration (IP address, date and time) will be deleted at the latest when you end your newsletter subscription.

Possibility to object / unsubscribe from the newsletter
You can unsubscribe from our newsletter at any time. You can find the link at the end of each newsletter. By doing so, you revoke your consent or object to further use of your data for the purpose of sending the newsletter.

5. USE OF FACEBOOK AND INSTAGRAM SOCIAL PLUGINS

a. Facebook Fanpage
We operate a fan page on the social media platform Facebook (Facebook Inc., Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, D2 Dublin, Ireland, ("Facebook"), which we have linked on our website via the Facebook icon. As long as you do not click on the link, Facebook will not receive any data from you (but please note the information on Facebook pixels below). If you click on the link, for example to view our company presence on Facebook or to "like" our page, Facebook receives data from you (which data Facebook receives also depends on whether you are logged in to Facebook while you click on the page or not). While Facebook uses this data under its own responsibility, among other things, to create profiles and to generate custom audiences, we can only see aggregated data on our company website, i.e. statistics that do not allow any personal reference. The link to our social media presence on Facebook and the associated data processing corresponds to our legitimate interests. The legal basis for this is therefore Art. 6 lit. f GDPR. It is also possible to block Facebook social plugins with add-ons for your browser, for example with the "Facebook Blocker".

b. Facebook Pixel
On our website we use the analysis tool Facebook Pixel by Facebook Inc., Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, D2 Dublin, Ireland, ("Facebook"). Facebook Custom Audiences works with a JavaScript code snippet that runs when someone opens a page. We use it to analyze the effectiveness of our advertising. We cannot identify individual users or specifically address them with advertising via our Facebook Business profile, only user groups.

We use Facebook pixels in such a way that the sending of pixel actions to Facebook is interrupted until the cookie consent has been given. With Facebook Pixel, we want to ensure that such visitors to our website are shown ads on Facebook that have certain characteristics (interest in certain products, gender, certain age, live in a certain city, etc.) fulfill. Facebook calls the grouping of users based on certain characteristics "custom audiences". The advertising should be shown on Facebook to potentially interested parties and not to those who are unlikely to be interested in our product.

Our Custom Audience consists of the "Custom Audience through websites" function, i.e. the Facebook pixel matches visitors to our website with people on Facebook. The following data is sent to Facebook:

Contextual data: This includes the redirect URL, browser information and the person's Facebook user ID (hashed).

In addition, the pixel helps to statistically understand the effectiveness of advertisements, which Facebook calls "conversion". The Facebook pixel tells us whether people in the target group have visited our website, searched for a specific product on our website, viewed a specific product or product category, whether a purchase was initiated, whether a purchase was completed. The Facebook pixel tells us if people were directed to our site from a paid search engine result and if people are interested in special offers. We can only see from the statistics that this happened - we cannot identify individuals.

We noticed that our product gets a lot more attention when we use Facebook Pixel. It is therefore in our legitimate interest to integrate Facebook pixels on our website (legal basis Art. 6 lit. f DS-GVO).

In your Facebook profile you can choose whether you want to receive personalized advertising. You can object to the collection by Facebook Pixel and the use of your data for Facebook Ads (as part of a Custom Audience). If your browser does not accept third-party cookies, the Facebook pixel will not be set.

c. Instagram
Functions of the Instagram service are integrated on our website. These functions are offered by Instagram Inc., 1601 Willow Road, Menlo Park, CA, 94025, USA. If you are logged into your Instagram account, you can link the content of our pages to your Instagram profile by clicking on the Instagram button. This allows Instagram to associate your visit to our site with your user account. We would like to point out that we, as the provider of the pages, have no knowledge of the content of the transmitted data or how it is used by Instagram.
